Comstock festivals' organizer in court on bad check charge

BROKEN BOW The organizer of Comstock's annual concert festivals appeared in Custer County District Court on Thursday on a felony bad check charge.

Henry Nuxoll, 52, of Comstock was charged in September with writing bad checks in excess of $1,500, a Class 3 felony.

Nuxoll owns the 2nd Wind Ranch near Comstock and has run the Comstock Windmill Festival, a country music event, there annually since 2000. Comstock Rock was added in 2002, and Godstock a year later.

Nuxoll was initially charged with writing about nine bad checks between June 12 and July 22 totaling about $100,000, according to Custer County Attorney Tami Schendt.

The checks were written from multiple accounts and were used to pay for expenses for the Windmill Festival and Comstock Rock.

Deputy Custer County Attorney Glenn Clark said Thursday that some checks have been dropped from the charge, but the total of the checks is still over the $1,500 threshold required for the charge.

Nuxoll was to be arraigned Thursday, but Clark said Nuxoll's attorney, Gregory Jensen of Ord, argued that there wasn't enough evidence in the case to bind it over to district court.

District Judge Karin Noakes said she would take Jensen's plea under advisement. No future date has been set in the case.
