A man charged with attempted second-degree murder for stabbing his estranged wife's boyfriend has pleaded guilty to felony first-degree assault.
In exchange for his plea, a charge of using a knife to commit a felony was dropped from the case against Jamie E. Tuggle, 26, 2721 W. Koenig St.
The charges stemmed from the March 18, 2007, stabbing of Nathan Hendrickson.
An unrelated case, assault by a confined person for an Aug. 10, 2007, incident involving Michael West, was also dismissed as part of the plea agreement.
His sentencing is scheduled for 10 a.m. March 26.
Tuggle was tried on the original charges in January but a mistrial was declared by Hall County District Judge James Livingston after it came to his attention that the jury had been given a police report that hadn't been offered or received as evidence, according to court documents.
The case had been set for trial in Hall County District Judge Teresa Luther's courtroom later this month.
Hendrickson described the stabbing during his trial testimony. He said he and his girlfriend, Bessie Tuggle, were in a car outside Jamie Tuggle's home when Tuggle came outside yelling. The men struggled and Hendrickson said he stomped and kicked Tuggle before getting back in the car to go to the hospital. He was treated for stab wounds to his thigh, forearm, his right side and the left side of his chest.
The defense presented evidence and witnesses to support their assertion that Tuggle acted in self defense.
